LICENCIAMENTO AMBIENTAL: ANÁLISE CRÍTICA ACERCA DAS FLEXIBILIZAÇÕES LEGISLATIVAS PARA A SOCIEDADE CIVIL NO BRASIL

Abstract

O licenciamento ambiental consiste num mecanismo de autorização emitida pelo órgão público competente. É direcionado a determinadas atividades ou empreendimentos potencialmente poluidores ou que degradam o meio ambiente, a fim de exercer o acompanhamento e um controle prévio das atividades que usufruam de recursos naturais. A licença é concedida unicamente para aqueles que atendam os requisitos necessários previstos na legislação específica. A pesquisa reproduz o conceito de licenciamento ambiental conforme a legislação. Seguidamente através de análises da literatura, foram obtidas as definições de competência para a expedição da licença, e a diferenciação conceitual de cada uma delas. O objetivo central da presente pesquisa, consiste na abordagem e a consequente análise acerca do tema licenciamento ambiental e seu papel essencial na sociedade civil, e também, ao meio ambiente ecologicamente equilibrado. Pretende-se, assim, apresentar reflexões com base nos princípios de direito ambiental e o desenvolvimento sustentável e que as possíveis flexibilizações legislativas discutidas na atualidade impactam no futuro das próximas gerações.

Environmental licensing consists of an authorization mechanism issued by the competent public body. It is aimed at certain potentially polluting activities or ventures or that degrade the environment, in order to exercise monitoring and prior control of activities that use natural resources. The license is only granted to those who meet the necessary requirements provided for in the specific legislation. The research reproduces the concept of environmental licensing according to the legislation. Then, through analysis of the literature, the definitions of competence for issuing the license were obtained, and the conceptual differentiation of each one of them. The central objective of this research consists of the approach and the consequent analysis on the subject of environmental licensing and its essential role in civil society, and also, the ecologically balanced environment. It is intended, therefore, to present reflections based on the principles of environmental law and sustainable development and that the possible legislative flexibilities currently discussed have an impact on the future of the next generations.
